Washington Usury Collection Check

Live. Collecting a Washington private loan? Cap is the higher of 12% or T-bill + 4 (RCW 19.52.020); above it recovery = principal less 2x interest paid.

Collecting a Washington private, online or unlicensed consumer loan? Checks each loan and contact against Washington's usury law: the maximum rate is the higher of 12% or 4 points over the 26-week T-bill yield (RCW 19.52.020); above it the creditor recovers only principal less twice the interest paid and less accrued interest, the debtor gets costs and attorney fees, and it is a Consumer Protection Act violation (19.52.030, 19.52.036). Also checks the setup charge on loans of $500 or less (19.52.020) and the 9% cap on medical-debt prejudgment interest (19.52.010). Business-purpose, retail installment and licensed or bank lenders are flagged out of scope. Flags collecting usurious interest (FDCPA 1692e(2)(A), 1692f(1)) and arrest threats. Not legal advice.
