Hospital ECA Gate
Coming soon. Collecting for a nonprofit hospital? Know when credit reporting, a sale or a lawsuit becomes allowed under IRS 501(r).
Checks planned actions on nonprofit (501(c)(3)) hospital patient debt against the IRS extraordinary collection action rules (26 CFR 1.501(r)-6), which bind the hospital's agencies and debt buyers: credit reporting, selling the debt (unless the buyer agrees to the four required terms), lawsuits, wage garnishment, bank levies, liens on a residence and deferring care. Applies the 120-day notification period from the first post-discharge statement, the written notice at least 30 days ahead with the plain language summary and an oral-notice attempt, the 240-day application period, financial-assistance applications (incomplete or pending: suspend; eligible: reverse actions and refund), emergency care and California's 180-day rule. Returns allowed or blocked per action and the earliest date. Facts and dates only. Early access pending legal review. Not legal advice.
