Florida Usury Collection Check
Live. Collecting a Florida private loan? Over 18% is usurious (Fla. Stat. 687.03): principal only, double interest paid (687.04); over 25% unenforceable (687.071).
Collecting a Florida private, seller-carried or unlicensed loan? Checks each loan and contact against Florida's usury law: more than 18% a year simple interest, with fees spread over the term, is usurious (Fla. Stat. 687.02, 687.03; over $500,000 only above 25%); a willful violator forfeits all interest, only the principal is enforceable and interest paid is forfeited at double (687.04, with the holder-in-due-course and pre-suit refund exceptions); over 25% is a misdemeanor, over 45% a felony, and the debt is unenforceable (687.071). Special-statute lenders and FHA/VA/agency loans are flagged out of scope. Flags collecting usurious interest (FDCPA 1692e(2)(A), 1692f(1)) and arrest threats. Not legal advice.
