FDCPA Coverage Check
Coming soon. Does the FDCPA and Reg F apply to you on this account? Debt, debt collector and state-law tests in one call.
Tells you whether the federal Fair Debt Collection Practices Act and Reg F apply to an entity collecting an obligation, and which state collection law applies when they do not. Checks that the obligation is a consumer debt (a natural person, personal, family or household purpose; taxes, fines and tort claims are not debts; child support and mixed-purpose debts are treated as covered until counsel decides) and that the entity is a debt collector (principal purpose of collecting debts, or regularly collecting debts owed to others; creditors that collect under another name), with every exclusion in 15 U.S.C. 1692a(6)(A)-(F): creditor employees, affiliates, government officers, process servers, nonprofit credit counselors, fiduciaries, originators and debts not in default when obtained. Applies Heintz v. Jenkins (lawyers who regularly collect), Henson v. Santander (debt buyers) and Obduskey (security-interest enforcement is covered by 1692f(6) only), and adds state laws that reach creditors collecting their own consumer debts (California, Texas, Florida, Massachusetts, Pennsylvania, Wisconsin, Maryland). Anything unclear comes back as treat as covered. Roles and yes/no facts only. Early access pending legal review. Not legal advice.
