Fair Lending Collection Check

Live. Does your collection strategy or scoring model treat consumers differently on a basis ECOA prohibits?

Reviews the inputs and treatment rules of a collection strategy, segmentation or scoring model under the Equal Credit Opportunity Act and Reg B, which cover collection procedures (12 CFR 1002.2(m), 1002.4(a)). Blocks race, color, religion, national origin, sex, marital status and public assistance income (1002.2(z)), name- or image-based inference of ethnicity or gender, and harsher treatment for consumers who disputed, asked for validation, complained, sent a cease request or have an attorney (the good-faith exercise of Consumer Credit Protection Act rights). Allows age only to favor consumers 62 or older (1002.6(b)(2)), servicemember status only for SCRA protections, and language only for language services. Flags likely proxies such as ZIP code, census tract, language and citizenship in settlement offers, contact intensity, legal referral, payment-plan terms and credit reporting, and asks for disparity testing, a four-fifths adverse impact check, a less discriminatory alternative review and a documented business need. Feature names and rules only. Not legal advice.
